Terms and Conditions

Please read the following terms and conditions carefully. You will be asked to sign a paper copy and return with your deposit.

BOOKING FEE: A deposit of 30% is required. Dates will be reserved only when this deposit is paid by cash or cheque. Please make cheques payable to Mr Stuart Hall. A full unconditional refund policy exists for a period of 14 days from receipt of the contract and payment. After that date, refunds are at the discretion of Stuart Hall Photography. If the event is cancelled for any reason later than one month before the agreed date, this deposit shall not be refunded. If the Photographer cancels this Agreement, the reservation deposit shall be returned to the Client immediately in full.

BOOKING FORM: Upon agreement in principle to photograph a wedding or other event, the photographer will meet the clients and request a booking form be signed and the deposit paid to reserve a date for the photography.

PAYMENTS: The balance of payment for the photography will be invoiced six weeks prior to the wedding and must be settled one month before the wedding day by either cash or cheque. Any bank charges incurred due to returned cheques will be charged to the client. In the event of either the deposit or balance, paid by cheque, cash or otherwise, not clearing in a UK bank any dates reserved will become available to other wedding parties with immediate effect.

REQUESTED PHOTOGRAPHS: The photographer will honour all photographs requested and agreed in advance, provided the following factors are met: Weather and allocated time permitting, availability and co-operation of the person/s concerned.

PARTIES CO-OPERATION: The parties agree to a cheerful co-operation and communication for the best possible result within the definition of this assignment. The Photographer recommends that the Client designate an "event guide" suchas the Best Man or an Usher, to point out important individuals for informal or candid photographs to the photographer during the event and to help with organising people for group photographs. The Photographer is not responsible if the key individuals fail to appear or to cooperate during photography sessions.

COVERAGE: The Photographer cannot be held responsible for the lack of coverage caused by: the bride, the groom or wedding party not being on time, the Church, Register Office, or licensed place of wedding having restrictions regarding photography. The Photographer does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. Additional coverage beyond the agreed times will be invoiced at £100 per hour.

LIMITATIONS OF LIABILITY: The Photographer agrees that every effort shall be made to provide high quality photographic services. In the unlikely event that a catastrophic mechanical failure should occur to the Photographer's equipment or transport or the Photographer is unable to provide the Client with the agreed upon photography services in whole or in part, due to (including, but not limited to) a fire or other casualty, acts of God or nature or terror, a burglary or other causes beyond the control of the parties, the Photographer agrees to reimburse the Client for all amounts paid to date but shall have no further liability with respect to this agreement.

WEATHER & ILLNESS: Stuart Hall Photography cannot be held responsible for images and photography sessions being disrupted by adverse/unfavourable weather conditions. Stuart Hall Photography shall not be liable for any amount in excess of the retail value of your package. Stuart Hall Photography may substitute photographers to take photographs at your wedding in the event of photographerÕs illness. All re-orders shall be considered an extension of this contract. All re-orders must be paid for in full prior to orders being dispatched.

EXCLUSIVITY: Stuart Hall Photography shall be the exclusive photographer retained by client. Family and friends are permitted to take photographs as long as they do not disturb, disrupt or interfere with photographerÕs duties. The photographer has the right to kindly ask the person obstructing to refrain from doing so, in order for Stuart Hall Photography to carry on their duties. It is our duty to provide you with a unique service. Any breach of this agreement will constitute a reason for non-completion of the job with no liability to the photographer. Stuart Hall Photography reserves the right to use your images for any form of advertising to promote the company. Web based promotions, brochures, galleries and competitions apply.

COPYRIGHT: The Copyright of all the photographs produced is retained by Stuart Hall Photography and it is a criminal offence to make copies from them by any means including video under the terms of the COPYRIGHT, DESIGNS and PATENTS ACTS 1988.All of the photographs produced by the Photographer throughout the event are protected by the British and International Copyright Laws and remain the intellectual property of the Photographer unless the payment for the services rendered was made in full by the Client prior to the production of the photographs, in which case the copyright ownership of the resulting images is automatically transferred to the Client.

Every care is taken in photographing and processing using professional materials. In the unlikely event of total photographic failure i.e. during exposure or processing, the Photographer's liability shall be limited to a full refund of all monies paid.
